3. You shall comply with the registration and application procedure prior to using the Service, including an express acceptance of these Terms. By registering for and using the Service, you acknowledge you have read and agree to be bound unconditionally by all of the Terms. If you do not agree to or do not accept any of these Terms, please do not use or access the Service.
4. Service Provider reserves the right to change, add to, delete or otherwise vary the Terms from time to time, at our sole discretion without prior reference to you. If these Terms are so amended, the amended Terms will be displayed when you next access the Service. Service Provider is not obliged to bring the various amendments to your attention. By using the Service after the amended Terms are posted, you agree to be bound by the amended Terms and Conditions. Accordingly, you must review the Terms each time you access the Service. You may subsequently withdraw your consent by providing fourteen (14) days written notice to: unsubscribe@wirewuss.com Queries relating to the collection, use or disclosure of Personal Data can also be directed to the same contact provided above.
6. Service Provider accepts no liability whatsoever in relation to information, including Personal Data which you may choose, on your own, to make available to third parties while using the Service. As information transmitted through the Internet is in general not confidential, your privacy or protection of your data is not and cannot be guaranteed. You agree you are solely responsible to take all such measures as may be necessary to protect your privacy and your data, and the Service Provider shall not be liable for any loss or damage suffered by you or any third parties due to your use or failure to use the Service. If you are unable to take steps to protect your privacy or data, please do not use the Service.

User's Conduct, Obligations and Representations

7. You undertake not to use the Service in violation of any laws or regulations applicable from time to time; or to misuse the Service in any manner deemed inappropriate by Service Provider.
8. You hereby represent and agree that you have read, understood and accept these Terms, and that in the course of your access to and use of the Service, you shall:

   3. comply with all notices, directions or instructions given by the Service Provider from time to time in respect of the use of the Service.
9. Due to the nature of this Service, there is an inherent risk of wrongful, illegal or unauthorised access by third parties to your account. You hereby acknowledge and accept the risk of such wrongful, illegal or unauthorised access and hereby agree that Service Provider shall not be liable for any loss or damage arising from such activities in general.
10. It shall be your responsibility to maintain the secrecy your User ID and password at all times. Service Provider shall hold the User solely responsible for all unauthorised or illegal transactions or activities carried out under your User account.

Disclaimers

11. You are solely responsible for the use of this Service. Service Provider does not guarantee the suitability of this Service for any specific application or purpose intended by you. Further, the signal strength may vary or be lost altogether from time to time and the Service may be disrupted. In such event, the Service Provider will use reasonable efforts to rectify the matter. However, neither the Service Provider not the Venue Owner is liable to you or any other party for any direct, indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, loss of data or any other issue arising out of the above.
12. Notwithstanding any other provision of these Terms, you agree that your access to this Service is completely at the discretion of Service Provider and Venue Owner, both of which reserve the right to suspend or terminate your access at any time without prior notice to you for any reason including, but not limited to, your violation of any of these Terms. In addition, the Service may be discontinued or changed by Service Provider at any time without notice.
13. The Service and any products or services provided on or in connection therewith are provided on an "as is" and "as available" basis and without warranties of any kind. All conditions, representations, indemnities, guarantees and warranties (whether express, implied or arising by operation of law, custom or the prior statement(s) of any party), including, but not limited to, any warranty of satisfactory quality, merchantability or fitness for a particular purpose, are HEREBY EXPRESSLY EXCLUDED AND DISCLAIMED to the fullest extent permitted by law.
14. There is no provision of any warranty whatsoever in respect of the Service and neither Service Provider nor the Venue Owner owes you any liability for any cost, claim, liability, expense, demand or damages whatsoever (including, but not limited to, any loss of profits, lost savings or incidental or consequential damages) arising out of your use of, or inability to, or disruption during, use of the Service, even if the Service Provider and/or the Venue Owner have been advised of the possibility of such damages, or for any claim by any other person whatsoever.
15. For clarity, any condition or warranty which may be implied or incorporated within these Terms by reason of statute or common law or otherwise (including warranties as to satisfactory quality and fitness for purpose) is HEREBY EXPRESSLY EXCLUDED. While every care is taken in the provision of the Service by the Service Provider, neither the Service Provider nor the Venue Owner shall be liable for any loss of information howsoever caused whether as a result of any interruption, suspension, or termination of the Service or otherwise, or for the contents, security, accuracy or quality of information available, received or transmitted through the Service.

Indemnity

16. You agree to indemnify, defend and hold harmless Service Provider, Venue Owner and their respective directors, officers, employees, suppliers, licensors and agents from and against any losses, damages, claims, costs, expenses, demands and actions due to or arising out of your use of the Service, your non-compliance with these Terms or your violation of the rights of other users or telecommunication service providers. Your obligations herein will survive any termination of your relationship with Service Provider or your use of the Service.

General

17. This agreement shall be construed in accordance with the laws of Singapore and you agree to the non-exclusive jurisdiction of the Singapore courts.
18. If any provision in these Terms is found or held to be invalid or unenforceable, then the meaning of such provision shall be construed to the fullest extent allowed by law so as to render the provision valid and enforceable, and if no such construction is possible, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.
19. Neither the Service Provider nor the Venue Owner shall have any liability for failure to perform due to unforeseen circumstances or causes beyond their control and without the fault or negligence of the Service Provider or the Venue Owner including but not restricted to acts of God, acts of the public, enemy, decrees or restraints by governmental authorities, strikes, war, riots, insurrections, civil commotion and other causes of such nature. In any of the events mentioned above, Service Provider and/or the Venue Owner shall for the duration of such event be relieved of any such obligation under these Terms as is affected by the said event.
20. No failure on the part of Service Provider to exercise, and no delay on their part in exercising, any right or remedy will operate as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other or further exercise thereof or the exercise of any other right or remedy. The rights and remedies provided in these Terms are cumulative and not exclusive of any other rights or remedies (whether provided by law or otherwise).
21. The headings used in the Terms of Use are included for convenience only and will not limit or otherwise affect the terms and conditions herein.
22. These Terms, together with any terms and conditions incorporated herein or referred to herein constitute the entire agreement between you (on the one part) and Service Provider and/or the Venue Owner (on the other part) relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on the Service.
